Post-Truth on Trial: Deborah Lipstadt vs. David Irving

On 26th February 2019 barrister Richard Rampton QC will talk about his victory in one of the most famous court cases of the last 20 years. The subject of the 2016 film, Denial, Richard defended Penguin Books and Deborah Lipstadt against Holocaust denier David Irving in a lengthy court case in 2000. Lipstadt is Dorot Professor of Modern Jewish History and Holocaust Studies at Emory College, Atlanta, Georgia; she had accused Irving of Holocaust denial in her book Denying the Holocaust.  


Irving wanted the trial to take place in England since English libel law places the burden of proof on the defendant rather than the plaintiff. Richard described the extensive amount of research which was required to prepare for the case. This included visiting the Auschwitz death camp and commissioning scientists to study the amount of Zyklon B gas remaining there. Furthermore, Richard learnt German in order for him to understand the nuances in the various surviving primary sources. Historians such as Richard Evans, Christopher Browning and Peter Longerich were called as witnesses for the defence. The defence team felt strongly that a Holocaust survivor should not be put through the ordeal of being cross examined under oath by Irving, since he was representing himself in court. Richard described how the case was won by proving that Lipstadt’s accusations against Irving were in fact true and not libellous.
